3. Commencement Notice with Opt Out Declaration

This type of notice is used where the owner is choosing to Opt Out of the requirements for statutory certification, to appoint an assigned certifier and submit a Certificate of Compliance on Completion, and can only be used for the following types of development:

  • The construction of a single domestic dwelling on a single development site, or
  • The extension of a domestic dwelling by more than 40m²

This type of notice must be accompanied by a Declaration of Intention to Opt Out of Statutory Certification. It is important to note that compliance with Building Regulations must still be achieved and in signing an Opt Out declaration, an owner is declaring that they understand their statutory obligation to ensure that the dwelling or domestic extension is designed and constructed in accordance with all of the relevant requirements of the Building Regulations.

The fee for the submission of this type of commencement notice is €30 per building (subject to maximum as set out in the Building Control Regulations 1997 (as amended)).  For details relating to fees see Fifth Schedule to the Building Control Regulations 1997 (as amended).
